Can foreigners buy Vancouver condos?

Foreign Ownership Rules for Vancouver Condos

In most cases, a foreign national cannot currently buy a Vancouver condo for personal use or investment. Vancouver is within a census metropolitan area covered by Canada’s federal Prohibition on the Purchase of Residential Property by Non-Canadians Act. The restriction applies to many residential properties with three or fewer dwelling units, including condominium units, and is scheduled to remain in effect until January 1, 2027.

For this law, a “non-Canadian” generally includes individuals who are not Canadian citizens, permanent residents, or registered under the Indian Act. It can also apply to corporations and entities that are controlled by non-Canadians. The rules concern the purchaser’s legal status, not simply where they live or the currency used for the purchase.

There are limited exceptions. Depending on the circumstances, some temporary residents may be able to purchase Vancouver condos, including certain work-permit holders and international students who meet detailed federal requirements. Other exemptions may apply to spouses or common-law partners buying together where one purchaser is Canadian, as well as to some properties in specific development or zoning situations. Eligibility is fact-specific, so it should be confirmed before making an offer or removing subjects.

Even where a buyer qualifies for an exemption from the federal prohibition, provincial taxes may still apply. British Columbia’s Additional Property Transfer Tax is generally 20% of the purchase price for foreign nationals, foreign corporations, and taxable trustees buying residential property in Metro Vancouver, subject to its own exemptions and conditions. Buyers should also understand ongoing ownership requirements, including applicable vacancy and speculation tax rules, before proceeding.

  • Canadian citizens and permanent residents: can generally purchase a condo, subject to standard financing, tax, and strata requirements.
  • Non-Canadian buyers: should not assume a condo is eligible simply because it is a resale, presale, or investment property.
  • All purchasers: should review strata documents, monthly fees, rental bylaws, disclosure statements, and anticipated closing costs carefully.

Real estate rules, tax rates, and exemptions can change. Before committing to a purchase, obtain advice from a qualified real estate lawyer, tax professional, and licensed real estate representative who can assess your immigration status, intended use, and the specific property.
